Girl hacks ‘rapist’ father to death

A 21-year-old girl from Palitana in Bhavnagar district was arrested on Monday for hacking to death her father who allegedly raped her several times ever since her mother died a year ago.

Eldest of three siblings, Kailash Koli has reportedly confessed to the crime during preliminary interrogation by Palitana police, which have also seized the axe she allegedly used to kill her father at their house near the bus station.

The girl has been booked under section 302 of the Indian Penal Code.

Preliminary investigation revealed the deceased had been sexually abusing Kailash after he lost his wife a year ago.

Kailash reportedly told the police that in the past 12 months, she was raped several times by her father, Haka, at their home. Police said she was also worried about her two younger sisters, one of them a teenage.

“She said she killed her father in a fit of anger when he again demanded sexual favours on Saturday night,” police said, adding she killed her father when he was fast asleep. She hit him on his head with the axe and he died on the spot, the police said. ..Source.. by Express news service : Rajkot

Murder accused suspected ex of abusing daughter

The woman accused of the body-on-the-bonnet murder decided to kill her ex-partner because she suspected him of molesting their little daughter, a Crown lawyer told the High Court in New Plymouth yesterday.

Cindy Fairburn, 38, is alleged to have deliberately driven into the path of an oncoming car as Darin Paul Maxwell, 42, clung on to the bonnet.

The story of the 13km wild, crazy ride on State Highway 3 on August 6, 2007 unfolded in the High Court in New Plymouth yesterday.

The impact with the Isuzu was so severe, Mr Maxwell was flung from the bonnet and through the windscreen of the Isuzu.

His extensive injuries included bleeding lungs, a foot almost amputated, fractured legs and a deep cut on his shoulder.

Mr Maxwell died in the ambulance on the way to Taranaki Base Hospital.

The Isuzu's driver also suffered life-threatening injuries but survived after weeks in hospital.

Fairburn herself was knocked unconscious and critically injured, spending 15 weeks in hospital.

An infection resulted in a return to hospital where a leg was amputated.

Fairburn, who quietly wept as the jury trial started yesterday, has denied murdering her former partner and dangerous driving injuring the Isuzu driver, whose name is suppressed.

Fairburn's lawyers argue that her actions on the night were solely those of a woman defending herself from Mr Maxwell.

In opening, Crown prosecutor Cherie Clarke said Fairburn had been angry and upset since the Saturday before the fatal impact.

In response to her child's unusual cry after she was put to bed, Fairburn had gone in to her baby's room to find her tucked up in her cot, but without nappies and her nappy and pants neatly folded at the end of the cot.

In her mind, he had sexually abused their two-year-old daughter, Miss Clarke said.

The accused told others she wanted to either poison him or use a stun gun.

She reported the incident to police, taking them a cot sheet, hairs she said were pubic hairs she had found on the floor next to the cot and the underblanket so they could use them as evidence.

When told by police that Mr Maxwell would not be arrested immediately, she was angered, saying he should not be allowed to get away with it.

The accused had told a friend that if police were not going to do anything, she would.

On the Monday, the baby was examined by a paediatrician who found no evidence of a sexual assault and ESR tests weeks later found no evidence of semen on the baby's bedding, Miss Clarke said.

That night, she encountered Mr Maxwell at the Heritage Bar in Inglewood.

She had left the bar and he had somehow ended up on the bonnet of her car, Miss Clarke said.

Other drivers on the road that night described how Mr Maxwell was slipping and sliding across the bonnet as she veered across the white line on the main road in Inglewood, cars on the opposite side having to steer hard left to avoid her.

She then drove at speeds up to 120kmh on the open road with Mr Maxwell still clinging to the bonnet, Ms Clarke said.

At 9.53pm, nearly at the Mangorei Rd intersection, she suddenly and violently swerved her car directly into the path of the Isuzu which was travelling towards Inglewood, Miss Clarke said.

At the time, the accused's car was estimated to be travelling between 83 and 133kmh.

Weeks later, Fairburn told police that she had got a fright when he jumped on the bonnet outside the hotel yelling and screaming.

She had not wanted to stop the car in case he jumped into the car.

She said she had no memory of the collision.

The couple's history included a charge of Mr Maxwell threatening to kill her and the toddler in 2006.

But she withdrew her allegations saying she was concerned about his suicidal tendencies and she was charged with making a false statement.

Mr Maxwell had been convicted of assaults against two other women in 2002.

Defence lawyer Pamela Jensen said self-defence would be argued.

The accused did not murder Mr Maxwell nor did she intend to injure the Isuzu driver.

NZ- Murder-accused admits razing stepfather's house

A man accused of murdering his convicted sex offender step-father has admitted burning down his house.

Jamie Stewart Davies, 31, of Raglan, yesterday admitted a charge of arson at the start of his murder trial in the High Court at Hamilton.

Davies is charged with murdering his stepfather, Allan Wallace Davies, 57, whose body was found in his burned-out house in Struve St, Ngaruawahia, on September 28 last year.

Police arrested Davies four days later, in Tauranga.

An autopsy on Allan Davies showed he died before the fire, allegedly from injuries inflicted by the accused.

In his opening address, Crown prosecutor Ross Douch said Jamies Davies had arrived at his stepfather's home in the early hours of September 28 with the intention of confronting him.

The court heard that Allan Davies was due to be sentenced in the Hamilton District Court for historic sex offending. He had earlier been found guilty of five representative charges of committing indecencies with a girl under the age of 12.

Mr Douch told the court that in a taped interview at the Tauranga police station on October 2, Davies said he had "lost control" when confronting his step-father over his historic sex offending.

Davies admitted punching Allan Davies between 20 to 40 times.

During the taped interview, however, Davies insisted he had not gone round to the house to kill his stepfather but instead "to talk to him".

Mr Douch - citing a pathologist report - said Mr Davies' injuries included a 4cm fracture across his breast bone, an injury to the back of his head and neck injuries consistent with strangulation.

He said Davies had meant to cause the death of his step-father.

"He wanted him dead," Mr Douch told the jury.

The Crown is expected to call 18 witnesses, including a taxi driver who drove Davies to his stepfather's home on the day of the incident.

Defence counsel Paul Mabey QC, in his opening address, told the court that while Davies denied murdering Allan Davies, he did not deny killing him.

Mr Mabey said it was the jury's task to decide if Davies was guilty of murder or the lesser charge of manslaughter.

He said it was not a case of whether Davies could walk away free at the end of the trial.

I've no regrets.. I'd do it all again

A teenager who killed the neighbour who raped his mum spoke for the first time from prison last night and said: "I've no regrets."

But in an emotional phone call to the Sunday Mercury, Marc Bick said that he never meant to kill sex beast Derek Duffet.

"That man attacked my mum in our house," the 17 year-old said. "In some respects, he deserved what he got.

"But I didn't mean to kill him. I was just so angry and upset. I wasn't really thinking straight.

"I don't blame my mum for me being in prison because I love her. I'd do the same again if I had to."

Bick, from Newport, Shropshire, was 16 when he discovered that drug addict Duffet had attacked mum Yvonne, 48, after threatening her with a wrench.

Angry and confused, the teenager vowed revenge and confronted the brute a week after the December 20 attack.

When Duffet sneered "For f*** sake, it was only a bit of fun," Marc lashed out in fury with a cricket bat.

Duffet, 40, slumped to the floor where he banged his head - and died three days later.

His death was due to the fall, not the blow from the bat.

A-level student Bick, who got 10 GCSEs this summer and wants to eventually set up his own gardening business, was originally charged with murder.

But that was reduced to manslaughter, which he admitted at Stafford Crown Court earlier this month. He was jailed for three years.

Bick, currently in Stoke Heath Young Offenders' Institution in Market Drayton, Shropshire, added: "I don't regret doing something about the situation because he raped my mum.

"But I do regret that Duffet died because I honestly never meant to kill him.

"I was really worried about going to prison because I have never been in any kind of trouble before.

"But it's better than I thought it would be. I thought it would be really tough and I wouldn't be able to cope.

"Before all this happened things had been going really well.

"I was going out with a nice girl and I'd been going to college which I really enjoyed.

"I'm carrying on with my A-levels in here and I'm also doing gym. It's OK in here and I just have to get on with it, although Christmas is going to be weird without my family.

"I want to say thanks to everyone who has been on my side. I think 98 per cent of people would have done a similar thing if they had been in my situation."

Bick and Duffet had known each other well - they used to play chess together and go fishing at the nearby lake.

But 5ft 2ins mum Yvonne never suspected that her neighbour would subject her to such a horrific ordeal.

She told the Sunday Mercury: "Derek had popped round for some chicken. I would often give him bits of food because I felt sorry for him.

"I went into the outhouse to get some food out of the chest freezer and stood on a box to reach in. He followed me out there, held a wrench to my neck and then raped me.

"I couldn't scream because I didn't want my youngest son, Paul, to wake up and be scared. I didn't want to tell anyone. The children just thought I wasn't feeling very well."

Yvonne kept the attack from her eldest son, his sister Mikayla, now 16, and Paul, 11, believing that it would spoil their Christmas celebrations.

But Duffet started boasting about the way he had raped her, and Bick became suspicious after finding his mother crying.

Eventually, Yvonne told him what happened.

"Marc was so angry that he started sobbing," she said. "He was devastated but angry at the same time. He said he was going to get Derek - but I tried to stop him.

"He went round and Derek grabbed him by the shoulders. Then Marc hit him and, as he fell, he hit his head. He died three days later of his injuries.

"The doctors said if he hadn't been taking drink and drugs then he probably would have lived.

"Marc just wanted to hurt him, never to kill him.

"I really miss Marc and Paul misses him, too. He cried when Marc went to prison.

"But I'm glad Duffet is dead. He deserved it.

Victim killed own dad after teacher abuse, court told

THE sentencing of a former Marist Brother heard evidence yesterday from a man who killed his own father in the belief that he had gained financially from his sexual abuse.

Paul Gordon (43) says he was sexually abused by three brothers at St John's Primary School in Sligo in the 1970s.

Yesterday, waiving his right to anonymity, he was the sole witness in the sentencing hearing of former Marist Brother Martin Meaney (65), who has pleaded guilty to five sample charges of indecently assaulting Mr Gordon when he was eight. He will be sentenced next week.

It emerged in evidence that Mr Gordon believed his alcoholic father was being paid money by another Marist Brother to get his son to present himself to be sexually abused.

In 1983, Mr Gordon was jailed for eight years for the manslaughter of his father -- and only after his release did the truth emerge.

His claims eventually spearheaded a garda investigation which has led to hundreds of past pupils being interviewed and of charges being brought against five former teachers.

Gda Det Sgt Dermot Flannery told the court that Mr Gordon had shown "courage and determination in exposing a dark chapter in the history of the school".

Formerly known as Brother Gregory, Meaney taught in St John's from 1970 to 1972. In December 1991 he pleaded guilty to eight sample charges out of a total of 109 charges of buggery, indecent assault, sexual assault and rape of six boys at a primary school in Castlerea where he subsequently taught and he was sentenced to 18 years in jail. This was later reduced to 12 years on appeal.

He now lives alone in a bedsit in Dublin. He was questioned by Sligo gardai while still in Arbour Hill and he admitted he had selected Mr Gordon for abuse. "He was a pasty-faced, weak little lad, pale and sickly and I felt sorry for him. I did feel for boys who were deprived. I did pick the weakest lad in Paul Gordon," he said.

The abuse took place in the classroom after school and when he took the child for music classes.

Mr Gordon made his initial complaint in 1995 but the DPP recommended no prosecution. However in 1999, the garda investigation team was set up.

Indecent

In 1999 and again in 2001, retired teacher Michael Cunnane received suspended sentences for indecently assaulting eight boys.

In June 2005, Peter White (74), formerly Brother Agnellus, of Celbridge Abbey, Celbridge, Co Kildare, was sentenced to three years after pleading guilty to eight sample charges of indecent assault on two boys at the school.

In July 2005, a teacher at St John's National School, Sligo, Patrick Curran, was found guilty of indecently assaulting nine boys. He was sentenced to 12 years, since reduced to nine. ..more.. by Anita Guidera

Paedophile Murder

A British man is appealing against a 14 year sentence imposed by a Danish court for killing a paedophile who he says molested his nine-year-old daughter.

Fifty five year-old, Stephen Hoath, who has lived in Denmark for the last thirteen years, insists he and a Danish friend shot the man because local police refused to take action. The case is proving particularly controversial in a country where earlier this summer two young girls were brutally murdered by paedophiles. Many Danes are complaining that out-dated liberal attitudes are preventing the courts from taking action and there are fears that some might follow, Stephen Hoath, by taking the law into their own hands.

Mr Hoath befriended 63 year-old, Villy Andersen, whilst on a fishing trip. He claims his daughter later told him that Andersen had fondled her legs after she went with him to fetch a torch from their car. He then discovered that the man was a convicted paedophile who’d spent 18 months in jail for abusing a child a few years before. Hoath then reported the incident to the police but they claimed that there was insufficient evidence to take any action.

In response Stephen Hoath and a Danish friend, Ejvind Olesen, sent off with a loaded rifle to look for Andersen. On finally finding him Hoath, who has a previous conviction in Britain for attempted murder, shot him dead. Though his controversial solicitor, Peter Hjorne, who frequently represents Danish Hells Angels, insists Hoath had only meant to scare Andersen into leaving his daughter alone. Though quite how shooting someone in the eye can be a warning is hard to tell. Nonetheless, Hjorne claims the sentence imposed on his client for premeditated murder is outrageous given that he was only trying to defend the honour of his daughter.

I recently travelled to Assens jail, East of Jutland to interview Mr Hoath to get a clearer picture of what happened that day. Yet whilst he was willing the authorities were not and I was told he would not be allowed to talk to this programme. His lawyer has seen filed a complaint to the country’s Director of Public Prosecutions claiming this is a denial of Mr Hoath’s freedom of speech.

Ironically no such restrictions seem to be placed on Danish paedophiles. In fact they are allowed to have their own organisation which boasts his own fully legal web site. The Danish Paedophile Association, which sometimes carries full page ads in some newspapers, frequently has it’s say on the alleged benefits for children of having sex with adults.

It pronounces: “Paedophilia means love for children involving erotic feelings.”
And on another web page: “The claim that some child/adult sexual contacts are benign or even beneficial is supported by such a wealth of scientific studies that it cannot be discounted.”

How can they be allowed to say such things? Well, the Associations rights to freedom of speech…along with everyone else’s, are enshrined in the country’s constitution. They have the right to meet and express views provided they are just talking about sex with children and not actually having it. Save the Children Denmark is campaigning to have the website, along with the Association, closed down. The charity’s spokesman in Copenhagen, is Kumo Sorensen. Does he believe that the Associations members stop at talking? “No, I believe very much that they have sexual relations with children because they are so convinced that they don’t harm children.”

Proving what Denmark’s estimated 30,000 paedophiles are up to is a tricky business. Police point out that under Danish law they can’t convict an organisation they have to find evidence against individuals and then prosecute them. But the Head of Copenhagen’s CID, Detective Commander Per Larsen, says is easier said than done: “They are very clandestine. They almost work like secret agents because they are well aware of how dangerous it is for them to expose themselves to society. So, it is very difficult to investigate them in this environment.”

The other option is to change the law and exclude organisations like the Danish Paedophile Association from the right to Freedom of speech. But that is equally difficult. This right is enshrined in the country’s written constitution and amending that requires a referendum and two conclusive votes in parliament. It’s thought that even then such a move would be challenged by Paedophile Association lawyers.

The current situation horrifies journalist, Kristian Jensen, who was abused by a paedophile for three years from the age of nine. Since telling police he has spent more than 12 years receiving counselling and other help in coming to terms with the experience. “It is really, really outrageous. This is an entire government refusing to act. As we speak children are lying in beds being abused. As we speak there is an organisation in Copenhagen which is actually promoting the sexual abuse of children and no one is doing anything.” Mr Jensen is now campaigning for a change in the law which would outlaw the Danish Paedophile Association and close down their web site.

Meanwhile the police acknowledge that frustration is growing in Denmark about what many see as an ugly loophole in the law which puts children at risk. Anxious to defuse the rising tension, Commander Larsen has this advice for any one thinking of copying Stephen Hoath’s idea of vigilante justice:

Campaign to free father jailed for killing child molester

A Briton jailed in Denmark for murdering a paedophile who had molested his daughter should be released, campaigners said last night.

Stephen Hoath was sentenced to 14 years in prison on Friday in Odense, Denmark, after admitting shooting dead Villy Andersen, a convicted Danish child molester who had abused Hoath's nine-year-old daughter.

The case has gripped Denmark, with many commentators complaining that the police failed to take the original accusations of child molestation sufficiently seriously.

advertisementProtesters outside the court said that Hoath, 55, who has terminal lung disease, was a hero and that they were dismayed by the sentence. One man said: "He should be given a medal."

Hoath, a London-born factory worker who has lived in Denmark for 13 years, was found guilty of premeditated murder. He had admitted shooting dead Andersen, 63, on August 17 last year but denied murder. Ejvind Olesen, Hoath's Danish accomplice, also received 14 years.

Hoath's relatives reacted with fury at the sentences. His son Gerry, in his twenties, was arrested after spitting at the jury and warning them: "You are pigs. If you ever come to England, we'll kill you."

His daughter, Zoe, threw herself into his arms as he was being taken away and shouted: "You're a hero, dad."

Police said Hoath, who lived with his wife and daughter in Jutland, had first reported to them that Andersen had attacked his daughter in July last year.

She had alleged that Andersen, a truck driver who had recently become friendly with Hoath, had touched her over her clothing during a fishing trip. He had also suggested playing strip poker, she said. Andersen had lured the girl away from her father with the pretence of getting a torch from his car.

Detectives at first decided to take no action because there were no witnesses and no physical evidence. They did, however, decide to charge Andersen five days before his murder but had not done so at the time of his death. The police did not tell Mr Hoath of their intentions.

Hoath told the court that he had confronted Andersen about the attack. He said he had meant only to threaten him, but lost his temper when Andersen boasted he was going to molest his daughter again. Andersen allegedly said to Hoath: "I will get her again. You cannot always watch her."

In an interview from his prison cell earlier this year, Mr Hoath said: "I had to do something. The police did nothing. I couldn't believe it. He threatened to get my daughter again and still they did nothing. I tried to do everything by the book but in the end I had to protect her."

He said: "I never intended to kill him but I'm not ashamed of what I did. My wife is close to a breakdown. My daughter will live with what he did for the rest of her life - and now she's lost her dad."

Niels Pinborg, of the Ekstra Bladet newspaper in Copenhagen, said that Andersen was known to have several convictions for paedophile offences.
