Inmate death raises jurisdictional concerns

12-30-2011 Virginia:

Severely beaten Red Onion State Prison inmate Kawaski Bass could have arrived in an emergency room just beyond Virginia’s state line in less than two hours.

Instead, the state’s jurisdiction-based policy on hospital care made sure his battered and bruised body lay in the back of an ambulance for a nearly four-hour ride on Sept. 6.

“It amazed me to know they took him so far … despite other hospitals being in the area,” said Bass’ sister, Tarsha Bass.

Guards at the Pound-based prison found the inmate unconscious in his cell and initially had an ambulance rush him to the nearby Dickenson Community Hospital. But the devastating head injuries and internal bleeding were too much for the local medical center to handle.

So, doctors wheeled Kawaski Bass back into the ambulance and sent him to what is known as a Level I trauma care center - a hospital staffed night and day to tackle the most debilitating injuries.

A map shows the nearest such hospital to be Holston Valley Medical Center in Kingsport, Tenn., roughly 75 miles away.

Yet the ambulance was sent to Carilion Roanoke Memorial Hospital in Roanoke, Va., roughly 197 miles away. That way, guards could maintain their custody over the inmate.

“The Virginia prison system stipulates that we cannot transport their prisoners across state lines,” said Mountain States Hospital spokeswoman Teresa Hicks, whose company runs both the Dickenson and Kingsport hospitals.

Kawaski Bass died hours after arriving at the Roanoke hospital in the early morning of Sept. 7.

Hospitals

Bass would have had a handful of treatment options if the state line was not an issue.
Paramedics could have rushed him the 86 miles to Johnson City Medical Center in Johnson City, Tenn. It’s also a Level I trauma center and requires half the travel time as the trek to Roanoke.

Even closer, at 78 miles, is Bristol Regional Medical Center, considered a Level II trauma center because it lacks some round-the-clock surgical specialists, according to the American College of Surgeons, which ranks trauma centers. Still, the Bristol hospital is staffed with trauma surgeons to handle the worst injuries day and night.

“It sort of makes sense that you would want to be treated as soon as possible,” said Dr. Renan Castillo, of the John Hopkins Center for Injury Research and Policy.

Bass’ situation seems to have revolved around what the medical community calls the Golden Hour of trauma care – the theory that a patient’s greatest chance of survival is based on receiving the right surgical treatment within the first hour.

But it’s an unproven theory.

“There are a lot of surgeons that definitely believe in the Golden Hour,” Castillo said. “It’s definitely true that you’re racing against the clock on some level.”

Prison guards found Bass on the floor of his cell around 1 p.m. and prison medical staff performed CPR on him for nearly 60 minutes before finding a pulse, sister Tarsha Bass said.

The medical staff hooked Kawaski Bass to a respirator to help him breathe, the sister said, and shipped him by ambulance to the community hospital across the county line in the town of Clintwood. The American College of Surgeons does not rate the hospital as a trauma-care center.

Bass could have been transported to Roanoke by helicopter, which the Virginia State Police said is usually an hour-long flight. An ongoing rain storm made helicopter transport too dangerous, the Virginia Department of Corrections confirmed, and so the trip was done by ambulance.

The Virginia State Police covers parts of Southwest Virginia with an Abingdon-based Med Flight helicopter and confirmed that it has ferried state prison inmates to Roanoke.

On a clear night, the helicopter could have departed the community hospital in Clintwood and reached the Roanoke hospital within the Golden Hour.

It could also reach the Johnson City Hospital in 15 minutes.

“I think the policy needs to be changed,” Tarsha Bass said of the state-line rule.

“When it’s a matter of life and death … they should be able to bend it a little.”

Injuries

Though parts of the medical community consider the clock to be a dangerous foe, Virginia law does not.

“There’s nothing that says that people need to be sent to the closest hospital,” said Michael D. Berg, regulation and compliance manager with the Virginia Office of Emergency Medical Services.

In fact, Berg noted that the decision on where to send patients is usually left to the attending physician.

Hospital location becomes a legal factor only when it comes to Virginia’s prison inmates.

“It is a jurisdictional issue,” DOC spokesman Larry Traylor said in an email. “Our authority does not extend beyond the border of Virginia unless there is a specific prior agreement or extradition order of some type.”

Simply put, the DOC would lose custody of an inmate as soon as the ambulance or helicopter crossed beyond Virginia’s state line. An out-of-state judge would have to sign an extradition order just so Virginia prisons could retain custody all throughout the hospital stay and even past the eventual discharge.

Tarsha Bass, a licensed practical nurse from Hampton, arrived at the Roanoke hospital with her mother late at night.

A doctor told them that brain swelling and massive abdominal bleeding were the leading causes of her brother’s trauma.

At one point, hospital staff suggested that Kawaski Bass might undergo surgery to relieve the pressure on his swelling brain, the sister said.

He died soon after mother and sister arrived at the hospital. He was never wheeled into an operating room.

Kawaski Bass is the second of two inmates killed over the past 19 months inside Red Onion, a maximum security prison located near the Kentucky border.

The first happened July 28, 2010, when Robert C. Gleason followed through on a threat to kill again unless sentenced to death for slaying an inmate more than a year earlier. Gleason is now on Death Row awaiting a Virginia Supreme Court review of two death sentences.

With Bass, corrections officials and investigators refuse to confirm the cause of injuries or even a suspect because the investigation is ongoing.

The Bristol Herald Courier has learned that John Keyvann Watson, 31, is suspected of the altercation that left Bass, 31, unconscious in his prison cell.

Watson is serving 103 years for two counts of second-degree murder that stem from a 2002 attack in Richmond, court records show. The Virginia Department of Corrections has tentatively set his good-time release date for Sept. 7, 2100.

Kawaski Bass was serving a 65-year sentence for 1998 and 1999 convictions of robbery, use of a firearm, carjacking, assault and battery, and conspiracy in several Virginia counties and had a good-time release date of Jan. 21, 2061. ..Source.. by Michael Owens | Bristol Herald Courier

Mom sues state over son’s death at Virginia prison

BRISTOL, Va. (AP) — Officers ignored an inmate’s concerns that a prison gang was out to kill him and then let his cries for help go unanswered as he was beaten to death in his cell, the inmate’s mother claims in a lawsuit against the state and prison officials.

The lawsuit, filed last month in Hampton, claims officers at Red Onion State Prison didn’t respond to Kawaski Bass’ pleas for help. It also says the state failed to adequately train or supervise employees responsible for maintaining safety within the housing unit where Bass was attacked.

Bass, 32, was severely beaten in his cell on Sept. 6, 2011. He was pronounced dead hours later after a 200-mile ride from the prison in Pound to a Roanoke hospital.

He was “heard by other inmates within the housing unit screaming for assistance for several minutes and none of the corrections officers . responded to his pleas for help,” reads the lawsuit, filed by Richmond attorney Horace F. Hunter.

Virginia State Police have not charged Bass’ cellmate, John Keyvann Watson, 32. Bass has claimed he beat Bass because he was defending against a sexual assault.

Virginia Department of Corrections spokesman Larry Traylor; that it is department policy not to comment on pending litigation.

The lawsuit claims Bass told officers that members of the Bloods prison gang had indicated they planned to kill him. It says Bass was placed in a cell with Watson, who was a known associate of the Bloods.

Watson is serving 103 years for two counts of second-degree murder. Bass was serving a 65-year sentence for robbery, carjacking, assault and other charges.

The mother of another inmate, Aaron Cooper, also has given notice that she plans to sue the state and Red Onion officials over the death of her son at the prison in 2010.

Cooper was strangled to death by inmate Robert Gleason through a separate cage on the outdoor recreation yard. Gleason already had killed another inmate and vowed to continue killing unless he was given the death penalty.

Cooper’s mother gave notice that she may file a civil lawsuit because the prison “failed to properly segregate and monitor violent and dangerous criminals.”

Gleason was sentenced to death in September. ..Source..

Murders of prison inmates in Sterling, Colorado, spur state review

Department of Corrections officials will meet in Sterling today to try to understand why four inmates have been killed at the prison there in the past two years.

DOC executive director Tom Clements said he is meeting with Sterling Correctional Facility warden Kevin Milyard to be debriefed on each of the cases.

"We're looking at cell assignment protocols," Clements said. "We want to see if there are any common denominators. It's got my attention."

The focus is on Sterling because all other prisons in DOC have a total of just three murders in roughly the same time frame. .... ....

Five days earlier, convicted sex offender Mark Frederick Hanson, who was serving a two-year prison term for repeatedly failing to register as a sex offender, also was beaten to death at Sterling. Three of the four inmates killed there in the past 21 months were behind bars for either sex offenses or crimes against children. ....

Sanguinetti said DOC regularly takes measures to protect threatened sex offenders or child abusers or killers, including segregating them from the general population.

She said the inmates suspected of killing White and Hanson, who was murdered Nov. 25, are in segregation. The two were held in different sections of the prison, Sanguinetti said.

The most recent Sterling case was Lyle Brent White, a convicted child killer who had told his sister he feared for his life before he was beaten to death.

"He's been threatened ever since he's been in there," said White's sister Elizabeth. "This totally could have been prevented."

An inmate who beat White to death Dec. 1 at Sterling told investigators the "cho-mo" — or child molester — got what he deserved, his sister said.

White had not been convicted of a sex crime but was behind bars for the murder of an 11-year-old boy.

Five days earlier, convicted sex offender Mark Frederick Hanson, who was serving a two-year prison term for repeatedly failing to register as a sex offender, also was beaten to death at Sterling. Three of the four inmates killed there in the past 21 months were behind bars for either sex offenses or crimes against children.

The rash of prison murders is extraordinary in a county that will go years without a single homicide, Logan County District Attorney Robert Watson said.

Watson said that errors in prison classifications or placements may have contributed to the deaths.

DOC spokeswoman Kath erine Sanguinetti said Sterling has more than 2,500 convicted felons, or more than 10 percent of the state's prisoners, and violent confrontations do occur.

"Unfortunately, no matter how hard we try to protect them, sometimes this kind of thing happens," she said.

White's sister said investigators contacted family members a day after he was killed, asking whether he told them about any threats. He had, she said, adding that he had repeatedly been taunted about being a child killer.

White was convicted of killing 11-year-old Centennial Elementary School fifth-grader Antonio Davalos, then throwing the boy's body into a trash bin in Littleton.

Initially, DOC officials moved him out of state, including a stint in Idaho, because his crime made him a target. But he was returned to Colorado several years ago, White's sister said. Despite his repeated reports to staff that he was threatened, White remained in general-population cell blocks, where other inmates learned his background.

Sanguinetti said DOC regularly takes measures to protect threatened sex offenders or child abusers or killers, including segregating them from the general population.

She said the inmates suspected of killing White and Hanson, who was murdered Nov. 25, are in segregation. The two were held in different sections of the prison, Sanguinetti said.

Hanson was in prison after three convictions for failing to register as a sex offender.

In another case, Jaime Rodriguez, 29, has been charged with first-degree murder in the Jan. 13, 2010, beating death of David Guerrero-Estrada in his cell. Guerrero-Estrada was convicted in 2007 of attempted sexual assault of a child and sentenced to three years in prison.

Rodriguez has been found mentally incompetent and is being evaluated and treated at the Colorado Mental Health Institute at Pueblo.

Two Sterling inmates are suspected in the murder of habitual burglar Cleveland Flood, 38, who was beaten to death in February 2010. Watson said charges could be filed next month. He declined to name the suspects. ..Source.. by Kirk Mitchell

Sheriff: Dead motel robber was going to rape clerk

7-25-2011 South Carolina:

COLUMBIA, SC (WIS) - A man is dead after the motel clerk he tried to sexually assault and rob early Monday morning fought back and killed him, deputies said.

Investigators say 43-year-old Vincent Carson of Orangeburg entered Days Inn motel at 133 Plumbers Rd. near I-20 and North Main St. sometime before 6:00 a.m.

As the female clerk went into the breakfast room to prepare breakfast, she found Carson waiting inside. The victim said Carson held a knife to her throat and said "this is a robbery."

Investigators said when her attacker slipped the knife into his pants pocket to begin tying her up with plastic ties, the woman pulled a handgun from under her shirt, turned and fired into the man's chest at point blank range.

The victim was about 100 pounds lighter than Carson and stood at least a foot shorter than him, investigators said.

When deputies got to the scene just after 6:00 a.m., they found the suspect unresponsive on the floor. Richland County Coroner Gary Watts said Carson died from a single gunshot to the chest.

Richland County Sheriff Leon Lott said Carson's intent was not only to rob the motel, but also to rape the clerk. "There's no doubt that was his intent," said Lott. "Not only was he going to rob her, but he was going to sexually assault her. Now what was he going to do after that assault was over with, we don't know."

The clerk was not injured, but was taken to Palmetto Baptist Hospital as a precaution.

The suspect was wanted in at least one other motel robbery in the Midlands. The Orangeburg County Sheriff's Department was looking for Carson in connection with a July 14 robbery at the Hampton Inn on US Highway 601.

In that incident, deputies said Carson broke into the room of two elderly tourists and took their money, their cell phone and their vehicle.

Lott said that this was an unfortunate situation in which the victim feared for her life and defended herself.

Lott said the clerk had been victimized in one of two recent robberies at the same Days Inn and had gotten permission from her employer to carry a .22 caliber gun. The suspect in both of those incidents was identified as 22-year-old David Wesley Watson.

Watson is also believed to be the man who shot and killed Papa John's Pizza store manager Steven Fowler in June.

"Citizens need to be aware of their surroundings," the sheriff said. "If you see or hear anything that may be out of place or suspicious in nature, it's always best to use your better judgment and call law enforcement."

Man sought, woman arrested in hotel robbery

7-20-2011:

A woman has been arrested and a man is being sought in connection with the armed robbery of two tourists at Orangeburg's Hampton Inn.

Jessica Dawn Brown, 22, of 322 Ferncliffe Road, Elgin, has been arrested on charges of armed robbery, first-degree burglary and kidnapping.

Officials are still seeking 43-year-old Vincent Lee Carson of 1324 Saint Ann St., Orangeburg. He is also wanted on charges of armed robbery, kidnapping and first-degree burglary.

"It is important that the public provide any information to locate Carson as soon as possible. He is to be considered armed and dangerous," Orangeburg County Sheriff Leroy Ravenell said.

Deputies say an 82-year-old man and his 74-year-old wife were at the St. Matthews Road hotel last week when a gunman forced his way into their first-floor room.

The man demanded their cash and vehicle at gunpoint, the couple said. Warrants allege Carson held them against their will before taking about $750 in cash, a cell phone and a 2010 Chevrolet Equinox.

Deputies called OnStar, which informed them the vehicle was stationary at a Foxberry Court residence less than two miles away. After deputies located the unoccupied Chevrolet, a witness told them the driver got into a Kia with a female.

Warrants allege deputies found a cell phone and car keys at a Seif Road residence that Brown and Carson share. ..Source.. by T&D Staff

Man was beaten before his throat was cut, Paso Robles police say

5-1-2012 California:

Search warrant from slaying is revealed in court papers; victim’s death reportedly was revenge for alleged sexual assaults

Inside a hotel room in Paso Robles last summer, police found a dead man, lying face down on a bed, in a pool of blood. His throat was slashed, his chest and stomach were cut, and the left side of his face was crushed.

A conspiracy to beat the man and take his drugs apparently turned deadly when two members of a group returned after an assault on him and one of them allegedly sliced the man’s throat.

Four people suspected of the crime allegedly talked on the night of the attack about how the victim — 55-year-old Robert Kenichi Uyeno — had reportedly locked women up in his bedroom and raped them.

The Paso Robles Police Department cited the allegations in a search warrant filed in April in San Luis Obispo Superior Court. Police sought permission from a judge to obtain “buccal swabs” of the inner cheeks of each suspect to determine if the DNA samples match physical evidence and clothing they believe was used in the crime.

Three people — 33-year-old Alfonso “Pancho” Fierros, 30-year-old Tabatha Brown, 29-year-old Jennifer Velten — have pleaded not guilty to murder.

John Wesley Barrett, 42, was found mentally incompetent to stand trial and his case has been suspended, according to his attorney, Gael Mueller.

The warrant cites statements from female and male witnesses (who weren’t part of the criminal case) and two defendants, saying the four accused gathered at the Wine Country Inn in Paso Robles on the night of Aug. 21, where they consumed alcohol, heroin and methamphetamines.

They talked about how Uyeno had raped children and how wrong that was, the warrant states, though no specifics were noted about those claims. Uyeno doesn’t have a local criminal record of any sex crime.

A female witness told police that the suspects talked about how Uyeno had locked women in his bedroom, including Velten and Brown, and raped them, the warrant states.

A male witness also spoke with Brown, who said that Velten had complained that Uyeno hadn’t paid Velten for sex she performed, which led to their discussion about the claims of Uyeno’s history of sexual abuse.

The female witness told police the group became increasingly angry and she started to worry about what they’d do to Uyeno, urging them not to do anything because he was her friend.

The female witness eventually went back to her motel room because the group continued to speak badly of Uyeno, she told police.

Police described a conspiracy among the group that night to set up Uyeno and attack him.

The initial alleged plan was to beat up Uyeno and steal his drugs. Velten sent a text message to Uyeno saying she wanted to party with him in his room at the Farmhouse Motel in Paso Robles. Police later found a meth pipe and syringes at the scene.

The others then waited for a text by Velten from the room before Fierros and Barrett went to the motel while Brown waited in a truck. Inside the room, Barrett held Uyeno while Fierros pummeled him in the face and stomach with his fists for about two minutes, according to Barrett.

After the assault, Velten stole lotto tickets and methamphetamines, but Barrett told police he “did not steal anything because he did not like thieves,” according to the report, which paraphrases Barrett’s statements.

Barrett told police Uyeno’s pulse was strong and he was breathing when the group left to return to their motel. But Velten and Fierros returned to Uyeno’s motel room after Velten said she forgot her purse, Barrett told police.

When Velten and Fierros returned, Barrett told police he heard one of them say Fierros sliced the man’s throat.

Brown told police that Fierros later told her, after the incident, “now you know what kind of man I am.”

Defense attorneys representing the accused declined to comment about the case.

Velten’s attorney, Patrick Fisher, referred to it as an “ugly and unfortunate” case.

Fierros, Brown and Velten are scheduled to return to court May 17 for further proceedings. ..Source.. by Nick Wilson

First-degree murder charge filed against Kingman man; parts of victim found in desert

11-28-2011 Arizona:

KINGMAN, Ariz. -- A Kingman man accused of killing and dismembering a man he believed had molested his daughter has been jailed on charges that include first-degree murder.

George Loader, 34, was arrested Wednesday after a family member called the Mohave County sheriff's office to report that Loader had killed a man named "John" in the garage of a house in the 2200 block of East Devlin Avenue, police said. The relative said Loader and his girlfriend had been staying at the house while his mother was in Colorado.

The relative told police that Loader said he "lost it" when his 3-year-old daughter told him that "John" had touched her inappropriately, said Detective Jason Elsbury. The relative also told police that Loader said he chopped up the corpse, placed the body parts in bags and dumped them near a dirt track on the outskirts of Kingman.

A deputy found the body parts in the area. Police also recovered evidence at the house that included a bag of human hair, a box of blood-soaked towels and rags, multiple knives and a shotgun.

"The remains were badly burned, and the victim had been decapitated and had limbs removed from his torso," court documents stated.

The victim recently was released from jail and was living with Loader.

Spokeswoman Trish Carter said the sheriff's office was withholding the victim's identity until the medical examiner's office could positively identify the remains. ..Source.. by Dave Hawkins

Murder victim ID'd, molestation claims unproven

12-4-2011 Arizona:

Investigators with the Mohave County Sheriff's Office said they have been unable to substantiate claims made by a murder suspect that he killed a man because he molested his young daughter.

Although forensic identification of the body is still pending, the Sheriff's Office released the victim's name as John Oppenheim, a 41-year-old Fort Mohave man. Oppenheim was reportedly staying with George Loader, 34, following his release from jail on assault charges stemming from an incident earlier this summer involving his roommate, and resisting arrest.

Though he has not spoken with authorities, a search warrant sought by authorities indicates that Loader made statements to a family member saying that he had killed Oppenheim in a rage after Loader's 3-year-old daughter complained to him of being inappropriately touched. Sheriff's Spokeswoman Trish Carter said detectives have been unable to find evidence substantiating the claim and believe that it did not happen.

Oppenheim is believed to have been killed Nov. 22 but his dismembered and burned body was not discovered until the following day when a person with knowledge of the crime called authorities to report where the body had been dumped.

Loader Pleads Not Guilty In Ft. Mohave Murder Case

12-12-2011 Arizona:

A Kingman man charged in the murder and dismemberment of a Fort Mohave resident pled not guilty during his arraignment Monday. George Loader, 34, is charged with misconduct involving weapons, abandoning a body and first degree murder in thelate November slaying of 51-year-old John Oppenheim.

Court records indicate Loader told a relative he killed Oppenheim suspecting Oppenheim molested his three-year-old daughter. The Mohave County Sheriff’s Office has reported its investigation determined the suspicion was unfounded.

Loader is held without bond in the Mohave County jail pending a Thursday hearing to review release conditions. More case specifics could emerge during the hearing. ..Source.. by AZI News.com

Testimony: Single shotgun blast fatal in Kingman dismemberment case

12-18-2011 Arizona:

Authorities say a man killed over what a father has said was retaliation for molesting his daughter was shot in the face before he was dismembered.

The disclosure was made during a hearing Thursday in which Mohave Superior Court Judge Steven Conn said 34-year-old George Loader would continue to be held without bond in the first-degree murder case.

Mohave County Sheriff's Detective Jason Elsbury said Loader and the victim, John Oppenheim, are believed to have met while housed together in the same pod at the Mohave County Jail. Both were released and Oppenheim, 51, was staying with Loader, his girlfriend, their four children and some of Loader's relatives when he was reportedly killed at the home Nov. 22.

Elsbury testified Thursday that Loader's girlfriend said she was changing their 3-year-old daughter's diaper when she noticed a red spot. When she asked the girl what happened, she reportedly pointed at Oppenheim.

The girlfriend told detectives she told Loader about the girl's complaint and saw Loader go into the garage to confront Oppenheim before hearing a "bang," presumably the gunshot.

Elsbury said the Medical Examiner's Office said Oppenheim was shot once in the lower jaw and neck area. He did not specify how the body was dismembered but said investigators found a bloody saw along with bloody clothing and a bag of human hair in the garage.

Loader's girlfriend reportedly admitted to helping clean up the blood in the garage but she is not believed to have helped move the body to a dirt bike track off of Bank Street where the remains were dumped and set on fire. A canister of lighter fluid was found alongside the body, which had been beheaded and had its limbs removed.

All of the remains were found at the dirt bike track with the exception of the fingers, which have still not been found.

Elsbury said that after the murder was called in to authorities by an anonymous caller who was later determined to be a Loader family member, a search warrant was served at Loader's home at 3 a.m. Nov. 24. A 12-gauge pump shotgun believed to be the murder weapon was found in a drawer in his bedroom. The four children in the home were removed at that time and remain in the custody of Child Protective Services.

Elsbury said an examination by a nurse trained in examining sexual assault victims found no evidence that the 3-year-old girl had been molested. Detectives were also unable to corroborate the information in interviews with the girl.

Suspected child molester killed in Riverside

11-16-2011 California:

RIVERSIDE, Calif. (KABC) -- A gunfight broke out when officers tried to serve a search warrant in Riverside on Wednesday, leaving a suspected child molester dead.

Riverside police swarmed the Tyler Spring Senior Apartments in the 10400 block of Indiana Avenue just after 7:30 a.m. Many in the quiet community woke up to the sound of gunshots and sirens.

"Our detectives from the Riverside Police Department sexual assault and child abuse unit came to the location to serve a search warrant on a subject to who has several counts of child molestation," said Lt. Guy Toussaint of the Riverside Police Department.

The suspect barricaded himself inside the complex, prompting authorities to evacuate nearby residents and shut down Indiana Avenue.

The tense standoff ended about 2 1/2 hours later. The suspect was found inside his apartment dead from an apparent gunshot wound.

Officers initially opened fire when the suspect allegedly pulled out a shotgun.

It was unclear if the suspect died from police gunfire or from a self-inflicted gunshot wound.

"He did have what appeared to be gunshot wounds. The coroner will determine the cause of death," Toussaint said.

Riverside police say one officer suffered minor injuries while jumping out of the line of fire.

The suspect's name has not been released.

GA Child Sex Assault Suspect Killed In TX

7-13-2011 Texas:

Atlanta, GA — A man wanted in Georgia on charges of sexually assaulting a child and enticing a child is dead, shot down by police in Texas.

Fort Worth police were assisting the U.S. Marshals Task Force in hunting the suspect. They tracked him to a house in the 2000 block of Williams Place, near Northeast 28th Street in Fort Worth.

The man barricaded himself inside the home and a standoff began. The SWAT team arrived and tried negotiating with the man, but to no avail.

Then, after several hours holed up inside, the suspect emerged from a back door, holding a handgun. Officers say the man shouted to them, "I'm not going back to prison," then leveled the gun at them and fired twice.

He missed. They did not.

Officers returned fire, hitting the suspect several times. He was pronounced dead at the scene.

Suspect accused of sexual assault, abduction

NEWPORT NEWS, Va. (WAVY) - Two investigations are underway following a pursuit and standoff that ended with police killing an armed suspect.

The man was wanted for an abduction in York County, where police say he took a woman hostage at gunpoint at the Belmont At York Apartments on Saint Clair Circle. Police were first alerted to the situation at around 7:30 p.m. Sunday.

About 20 minutes later, a deputy spotted the suspect's car at a church in Newport News. "When he saw the vehicle, the windows were fogged, he shined a light on the vehicle, gave explicit orders to shut the vehicle down," said Lt. Dennis Ivey, Jr. with the York-Poquoson Sheriff's Office.

The suspect refused to stop.

Newport News police officers and York-Poquoson Sheriff deputies chased the suspect into a cul-de-sac at the end of Spring Trace Lane off Saunders Road.

When the Newport News tactical team arrived, neighbors who had gathered outside quickly took cover. "We were down there and one of the neighbors said we should probably get behind this wall and not even a minute after we got behind the wall we heard the gunshots," Caitlin Roberts told WAVY.com

During the standoff, one member of the Tactical Team opened fire and shot the suspect, who died at the scene. Police have identified the suspect as 40-year-old Robert Burchfield of Hampton. The female passenger was wounded and taken to the hospital, where she was treated and released. She was alert and talking to officers as she went into the ambulance. Police determined she was hit by flying debris and not gunfire.

The female victim is a 34-year-old York County woman. She told investigators that she was sexually assaulted by Burchfield in the 1000 block of Harpersville Road in Newport News, moments before deputies spotted their vehicle.

Investigators say the victim was Burchfield's ex-girlfriend.

A criminal investigation is being conducted by the Newport News Police Department's Homicide Unit. The Commonwealth's Attorney's Office will determine whether or not the shooting was justified. Meanwhile, an administrative internal investigation is underway. Woman shoots, kills suspect in sexual assault in Denton County

PONDER — Authorities were investigating the death of a suspect in a sexual assault case Wednesday who was apparently shot by the victim.

Denton County dispatchers got a call from a 29-year-old woman about 10 a.m. who said she shot a man who sexually assaulted her after she arrived at her parents' residence in the 1500 block of Seaborn Road, said Tom Reedy, sheriff's department spokesman.

The woman said that she had just dropped off her children and that the man, later identified as Wendell Dean McDonald, 28, was lying in wait for her and grabbed her, Reedy said.

The woman said McDonald took her inside her parents' residence, threatened her with her parents' gun and then sexually assaulted her, Reedy said. McDonald then told the woman to take the gun and shoot him or else he would shoot her, according to Reedy.

The woman initially refused to shoot him, but when authorities arrived, McDonald was dead from what appeared to be a gunshot wound to the chest, Reedy said. ..Source.. by Mitch Mitchell

Sexual assault suspect killed by police identified

6-20-2011 Arizona:

Tucson Police have identified 43-year-old Ernesto Agramont as the man killed during an incident on Jun. 15.

Diana Lopez, a spokesperson with Tucson Police tells KGUN9 detectives responded to 485 South Stone Avenue to locate and arrest Agramont for child sexual assault and child abuse charges.

When officers arrived, Agramont was immediately confrontational with detectives and made several statements referring to suicide by cop. Detectives asked for assistance to respond and help contain the home while they obtained a search warrant.

A short time later, Agramont exited his residence carrying a large knife. He was given numerous commands to drop the knife, which he refused to do continuing to advance towards officers. Officer Thomas Rizzi a 7-year veteran, Officer Jennifer Galaida a 9-year veteran, Officer James Wakeman a 10-year veteran, Officer Jobe Dickinson an 11-year veteran and Lieutenant Danny Denogean a 21-year veteran of the Tucson Police Department fired their weapons at the male striking him numerous times.

Man Shot By Police Has Prior Record

KPVI News 6 has learned that the man who shot an officer this morning and was then killed by police was a registered sex offender in Bonneville County.

According to the sex offender registry, 50-year-old Douglas Jay Walters was convicted of sexual abuse of a minor more than a decade ago. According to the report the incident happened back in June of 1995.

PREVIOUS STORY:

An Idaho Falls Police Officer is in good condition after being shot in the chest while attempting to apprehend a suspect who fled from a traffic stop early Friday morning.

At approximately 1:50 a.m. Idaho State Police made a traffic stop on Douglas J. Walters of Idaho Falls at the intersection of Whittier and Yellowstone Highway.

During the stop, ISP officers determined that 50-year-old Walters, who was driving a white pick-up truck, had an outstanding misdemeanor warrant. As officers began to take him into custody, Walters fled from ISP.

ISP pursued Walters and Idaho Falls Police intercepted Walters a short time later as he approached the intersection of Holmes and 17th Street. Police followed Walters to his home, located at intersection of 17th Street and Emerson Avenue.

Walters ran from the truck and went inside the home.

IFPD Officers Malin Reynolds and Bart Whiting and Bonneville County Deputies Tony Glenn and Chad Lanz followed Walters into the house.

Inside the home, Walters shot Officer Reynolds point blank in the chest with a handgun. Reynolds had come from around a corner and was attempting to apprehend Walters when he was shot.

Officers returned fire and killed Walters.

Officer Reynold’s bullet-proof vest stopped the bullet from penetrating. He was taken to Eastern Idaho Regional Medical Center as a precaution. Officer Whiting was also taken to EIRMC for an injury he sustained during the incident.

The Eastern Idaho Regional Critical Response Task Force is investigating the shooting.

Police: Woman Shot Intruder 9 Times In Self Defense

GWINNETT COUNTY, Ga. — An intruder who was shot and killed after a confrontation with a Duluth woman in her shower was likely stalking her for days and may have other victims, Gwinnett police said.

The 53-year-old woman, who is also a veteran private school counselor, was alone at the time of the Wednesday morning attack. She lives on East Mount Tabor Circle in Duluth.

The woman was getting out of the shower when she was met by a strange man with a kitchen knife, police said. They said there was a struggle in the bathroom, and she fell in the tub. Police later identified the man as Israel Perez Puentes, a Cuban national who lived in Alpharetta.

"The male was armed with a kitchen knife, a struggle ensued between the two of them. She fell in the bathtub injuring herself," Gwinnett police spokesman Edwin Ritter said.

The woman tried to fight the man off with a shower a rod, and he forced her into her bedroom, police said. They said she told her attacker she had money in the room. But she grabbed a .22-caliber handgun and shot the man nine times, police said.

Police said the man ran out of a back door and collapsed in the yard. He later died at the Gwinnett Medical Center. The victim, who was injured in the scuffle, was also taken to the hospital for treatment of non-life-threatening injuries. Police have not released her name.

Police told Channel 2's Kerry Kavanaugh they don't know why the woman was targeted.

"He may have seen her somewhere and he identified her as being a potential victim and he basically stalked her until he found the right moment to act on it," said Ritter.

"Our department is looking into any other cases around metro Atlanta area as well as our jurisdiction to see if he may be involved with any other sexual assaults that may have occurred."

Dan Tucker, a friend and neighbor, said he was amazed at how the victim defended herself against the armed intruder.

"She's smart, she's witty and obviously well prepared," Tucker said.

Ritter said the shooting investigation was ongoing but defended the victim, saying the shooting appeared to be justified, and that she acted in self-defense. He said there are no plans to charge her.

Police said Thursday that neighbors had spotted Puentes' car in the neighborhood several days before the attack but did not report it. Puentes' estranged wife told Kavanaugh he had been arrested for burglary in Johns Creek in December. ..Source.. by WSBTV.com

UPDATED: Attorney Convicted of Child Porn Killed in Prison

A 72-year-old retired attorney from Santa Fe was murdered at the California prison where he was serving a federal sentence for receiving child pornography on the Internet.

Robert A. Warren was attacked sometime before 7 a.m. Thursday at Federal Correctional Institution II in Victorville, Calif., a medium security facility housing more than 1,700 inmates, according to a news release provided to the Victorville Daily Press. He was pronounced dead just before 9 a.m.

Details about the cause of death were unavailable from the U.S. Bureau of Prisons.

Warren’s sole criminal conviction had generated heated discussion at sentencing about the appropriate punishment for the crime. Prosecutors sought nine years, saying Warren was more than the “passive voyeur” he claimed to be and had fueled the industry by saving thousands of child porn images.

The defense said the five-year mandatory minimum was more than enough punishment for a man with no criminal history, a history of philanthropic giving and a list of medical issues. Society would be better served by allowing him to pursue specific treatment outside of prison, it said.

Because Warren is dead, the conviction and indictment are expected to be dismissed. It’s unclear if the family could recoup the $50,000 fine he was required to pay.

A spokesman at U.S. Bureau of Prisons office in Washington, D.C., said Tuesday that the FBI handles homicide investigations in prisons.

Warren was charged in a seven-count, July 2009 indictment with receipt and possession of visual depictions of minors engaged in sexually explicit conduct. He pleaded guilty to a single count of receipt and was sentenced in February by Chief U.S. District Judge Bruce Black to the mandatory minimum five years.

“These mandatory minimums make it impossible for judges to tailor a sentence to fit an individual, especially someone as medically fragile as Mr. Warren,” said Marc Lowry, Warren’s attorney.

Lowry said he had written the Bureau of Prisons twice to urge transfer of his client after Warren was attacked within 12 hours of arrival at Victorville. Black had recommended Warren be allowed to serve his sentence at a federal medical prison facility.

Court pleadings filed by the defense say Warren had a variety of health problems, from diabetes and neurological defects that made him unaware of the effects of his behavior.


Federal prosecutors cited recognition by the Congress, the Supreme Court and U.S. Sentencing Commission that child exploitation offenses should be punished severely, noting that the clear trend since 2003 was to increase sentences.

“The child pornography industry would not be in business if there was not a demand from … (those) willing to pay money for such images and videos,” Assistant U.S. Attorney Charlyn Rees said in a sentencing memorandum.

Warren’s plea agreement reserved his right to appeal the court’s July 2010 ruling denying suppression of evidence against him.

Warren had sought to suppress the evidence based on an argument that the search warrant affidavit used was insufficiently specific and that it contained false information about a prior arrest attributed to him that was of a different Robert Warren.

In Warren’s plea to Count 2 of the indictment, he admitted knowingly receiving a video more than three minutes long that showed a man performing sexual acts on a girl tied with ropes. Forensic examiners identified more than 2,000 child pornography images from 141 child victims.

Court documents say Warren had been identified as a subscriber to child pornography websites in seven national investigations dating back to 2002, but he was not arrested until the FBI in 2007 used a fake new child pornography website to capture the Internet addresses of those who attempted to access it. ..Source.. by Scott Sandlin/Journal Staff Writer

Feds mum on death of Santa Fe man in prison

Federal Bureau of Prisons officials remain tight-lipped about the investigation into the death of a former Santa Fe attorney last week in a California prison.

But the attorney of Robert A. Warren, 72, who died in federal custody Dec. 29 after pleading guilty to child pornography charges, is being very vocal about his concerns that his client's death could have been prevented.

"He agreed to a period of incarceration. He didn't agree to be murdered," Marc Lowry, one of Warren's attorneys from the Rothstein law firm said Wednesday.

James Engleman, a spokesman for the Victorville Federal Correctional Complex, has not returned emails or telephone calls seeking comment on the death investigation. Lowry, meanwhile, said neither he nor Warren's widow have been apprised of many, if any, details into how her husband was killed or if anybody has been charged.

Lowry has little doubt his client was targeted from Day One in federal custody because of the nature of his crimes. Warren, Lowry said, was first attacked at the Victorville prison facility in Adelanto, Calif., within 12 hours of his being transferred there in July after his guilty plea and five-year sentence for a charge of receiving child pornography on the Internet. While waiting for his morning medication the morning after arriving at the facility, two fellow inmates attacked Warren, landing him in the hospital and in protective custody for much of his prison stay after that.

"I think he was targeted because of the charges against him, and that's a problem because the Bureau of Prisons knows that people entering prison with these types of problems are subject to abuse," Lowry said. "It is their duty to protect inmates they know are targets."

Lowry and co-counsel Peter Schoenberg wrote in July to both the U.S. Department of Justice and to the warden of the Victorville prison asking to have Warren transferred, to no avail.

Aside from Warren being targeted by fellow inmates, the 72-year-old man walked with a cane, had diabetes and wasn't in the best physical condition, which is why, Lowry said, U.S. District Judge Bruce D. Black recommended at sentencing that Warren be confined to a medical prison facility in Arizona. Warren had no prior criminal record.

But once in federal custody, the Bureau of Prisons does not have to adhere to a judge's recommendations.

"I think that's one of the tragic downsides of this, that the federal Bureau of Prisons should be considering some sort of facility solely for people with charges like this," Lowry said.

The sentencing itself for Warren allowed no wiggle room for Black, because Congress has approved guidelines requiring mandatory sentences that leave no discretion to sentencing judges.

An alternative for a man such as Warren, Lowry said, would have been house arrest with an ankle bracelet and no access to the Internet, children or a smart phone while serving his sentence.

"His death is a tragic loss for the community," Lowry said. "There was widespread support for Mr. Warren within the community, and everyone that came to the sentencing was mystified that a man of his age and in his physical condition could get a sentence for so long. ... The tragedy here is judges aren't allowed to escape the mandatory sentences called for by Congress."

The Rothstein firm was appealing Warren's conviction related to an issue the defense had with how police conducted a search of Warren's home.

Lowry said it would be premature to discuss whether the firm and Warren's widow will be seeking legal action against the Bureau of Prisons for Warren's death. ..Source.. by Geoff Grammer

Police ID man killed on Santa Ana River Trail

12-30-2011 California:

ANAHEIM – A man stabbed to death on the Santa Ana River Trail, near the 91 freeway, has been identified as 42-year-old Lloyd Middaugh, police said Friday.

About 6:15 a.m. on Wednesday, a person exercising on the trail called police to report a person down between Tustin and Lakeview avenues, Anaheim police Sgt. Bob Dunn said.

Police and paramedics responded to the trail and found a man, later identified as Middaugh, suffering from at least one stab wound, Dunn said. He was pronounced dead at the scene.

"There is information that he lived under the freeway overcrossing but we are not certain," Dunn said, adding that there was no indication that Middaugh, who was about 6 foot 4 inches tall and about 300 pounds, had been moved.

The motive for the stabbing is under investigation, Dunn said, and the weapon was not found.

Detectives are investigating whether the incident is related to another fatal stabbing involving a transient on Dec. 21 at a shopping center in Placentia.

Middaugh was a registered sex offender, according to the Megan's Law online database. Police indicated that he was required to register after a crime that occurred more than 20 years ago in San Diego.

The popular Santa Ana River Trail stretches 30 miles along the Santa Ana River, from Huntington Beach to the Orange-Riverside county line.

Arrest Made in Slaying of SoCal Homeless Men

Alert citizens chased a man down and led police to him in a Friday night attack of a homeless man in Anaheim

The man arrested in connection with the Friday night killing of a homeless man in Anaheim is being held as the main suspect in a month-long string of transient murders in Orange County.

"We are extremely confident that we have the man who is responsible for the killing of four homeless people," Santa Ana Police Chief Paul Walters said in a press conference Saturday afternoon.

Itzcoatl Ocampo, 23, of Yorba Linda, is being held at the Anaheim Jail without bail, said Anaheim Police Sgt. Bob Dunn, a department spokesman.

Friday's stabbing was the fourth such killing of a homeless person in OC.

Officials will ask the District Attorney to pursue four counts of murder against Ocampo, Walter said during the press conference.

"This is great news to know that's been caught," Brad Olsen, brother-in-law of victim Lloyd Middaugh, told NBC 4. "Prayers have been answered. We feel blessed that it's over."

Middaugh was one of four homeless men killed in the area since December. James McGillivray, 53, was stabbed to death Dec. 20 near a Placentia shopping mall. Lloyd Middaugh, 42, was found on the Santa Ana River trail in Anaheim on Dec. 28. Paul Cornelius Smit, 57, was killed outside a Yorba Linda library on Dec. 30.

The latest victim, John, was killed after 8 p.m. Friday behind a Carl's Jr., at 3110 E. La Palma Ave.

The victim has not been identified, but locals called him “John” and believe he is a Vietnam War vet in his mid-60s.

Anaheim Deputy Chief Craig Hunter said the man arrested fits the description of a man wanted in three stabbing deaths - in Anaheim, Placentia and Yorba Linda - dating to Dec. 20.

“I saw (John) at CVS about a week ago and I started crying when he said he wanted to leave the area and I hugged him,” a woman told NBC4. “But then I saw him and I was so happy he was still here, but I've been busy and I didn't have time the last couple of days to say 'hi.'”

The suspect, chased away by some people who saw him running, was caught on La Palma about a quarter-mile away in next-door Yorba Linda.

Police were believed to be questioning more than two dozen witnesses, whom they recognized as "brave citizens" during the public meeting Saturday.

A task force of local police and the FBI had been set up to investigate three homeless men who were killed in December at the hands of what police believed was a serial killer.

Former Marine pleads not guilty to 6 murders

SANTA ANA, Calif. (KABC) -- Itzcoatl Ocampo, the former Marine accused of killing four homeless men and two other people, pleaded not guilty to charges on Tuesday.

During the hearing, Ocampo mumbled to himself and at times appeared to smirk. His own defense attorney said his client is mentally ill.

"He's cracked. He's ill. He's got a mind that is wounded. His mind is so fractured that I think it's hard for him to understand not only the gravity, but even where he is right now," said defense attorney Randall Longwith.

The 23-year-old is charged with stabbing four homeless men to death. The murders took place in Orange County over a three-week period starting in December. It ended with Ocampo's arrest as he ran from the scene of the fourth murder in Anaheim.

Ocampo is also charged with stabbing to death a mother and son in Yorba Linda last October. Unlike the homeless victims, authorities allege Ocampo knew 53-year-old Raquel Estrada and her 34-year-old son Juan Herrera through Estrada's younger son.

Family members of one of Ocampo's homeless victims, 42-year-old Lloyd Middaugh, came to court to see the suspect. Middaugh was found stabbed more than 40 times along the Santa Ana River Trail in Anaheim.

"I'm kind of sick to my stomach," said Marie Middaugh, the victim's mother. "I can't wrap my head around it. It just doesn't seem possible."


Longwith said he has not yet decided whether to use an insanity defense, but stressed that Ocampo was affected by his eight months in Iraq. While he did not see combat, his attorney said Ocampo drove a truck and would have to deal with wounded and deceased people.

UPDATE: Investigators scramble for answers in Caldwell man's death

LENOIR -- The Caldwell County Sheriff’s Office is staying tight-lipped about the circumstances surrounding the death of Matthew Jason Carter, 32, of Lenoir.

“We’re working this as a murder investigation,” said Sgt. B.J. Fore of the Caldwell County Sheriff’s Office, “We’ve got the SBI helping us out on it.”

The sheriff’s office announced on Dec. 22 that Carter had been reported missing from his home on Walnut Drive where he was last seen on Dec. 15. Five days later, deputies found Carter dead in a wooded area off Crump Rd. in Lenoir.

Several of the investigators working on the case were present at the autopsy performed Thursday.

“We’re hoping that will give us a little more information,” Fore said.

He wouldn’t discuss any possible suspects in Carter’s death, how he died or what motive there may have been for murder. Fore said his reluctance to talk stemmed from the fact that investigators don’t have all the answers. They’re asking the public to come forward with new information – not wild theories based on what they’ve read in the media’s coverage of the crime.

The photo the sheriff’s office distributed when they announced Carter was missing was a mugshot.

Fore said it was taken when Carter, a registered sex offender, was arrested for pornography – not a crime directly against a person.

“He doesn’t have a history of arrest since then. He’s never been involved with anything violent,” Fore said. “We don’t think that played any part in his death.

Cause of death determined for Lenoir man found earlier this week

The cause of death for a Lenoir man who was found dead earlier this week has been determined. The autopsy performed on 32-year-old Matthew Jason Carter determine that he was killed by a gunshot wound to the chest.

Carter was reported missing last week and was found dead Tuesday in a wooded area near Crump Road in the Gamewell Community. The Caldwell County Sheriff's Office is investigating the case, at this time they are releasing little information.

Authorities say woman stabbed Diamond Bar man to death before dismembering him

RANCHO CUCAMONGA - A prosecutor said Thursday that the head and arms of a slain Diamond Bar man were recovered by police Wednesday in two large flower pots at a Bell Gardens house.

The victim, 63-year-old Samuel Wiggins Jr., was allegedly stabbed to death by his girlfriend, Carmen Montelongo of Riverside, then dismembered, authorities said.

Authorities believe both the killing and the dismemberment may have occurred at Wiggins' Diamond Bar home in the 23700 block of Meadow Falls Drive.

"Probably, but we can't be sure," said David Hidalgo, a supervising deputy district attorney in San Bernardino County.

Montelongo is accused of hiding Wiggins' head and arms in two separate flower pots that she delivered to a relative's home in Bell Gardens. She allegedly buried the rest of his body in the backyard of a relative's home in Ontario.

An autopsy was performed Thursday on Wiggins' remains. Based on the examination, a medical examiner found that Wiggins likely died from multiple stab wounds, said Deputy District Attorney Erica Gallegos, who attended the autopsy.

It also confirmed the body's identity through fingerprints, dentures and unique surgical scars, Gallegos said.

Montelongo was arrested Sunday in Ontario after she allegedly exhumed Wiggins' body in the backyard of a relative's home in the 700 block of North Holmes Avenue, then loaded the remains into a trash can.

Police arrested her after she wheeled the container about 200 yards through residential streets.

A cousin who lives at the Holmes Avenue address said this week that Montelongo may have buried the body about a month ago during what she said was a gardening project.

Hidalgo said police aren't certain of Montelongo's motive in her alleged killing of Wiggins. But he said it may have been for financial gain.

Montelongo used Wiggins' credit cards after his disappearance and was also in possession of his car, Hidalgo said.

When she was arrested, Montelongo told an officer that the body in the trash can was that of a man who assaulted her, according to a declaration from Ontario police Detective Al Parra contained in Montelongo's court file.

Montelongo's son and daughter were arrested at 7 p.m. Wednesday in Rancho Cucamonga on suspicion of being accessories to Wiggins' killing.

Daniel Ortiz, 25, and Chanel Alicia Ortiz, 26, have not yet been charged by the San Bernardino County District Attorney's Office, but they may be after police deliver reports to prosecutors about the siblings' alleged crimes, Gallegos said.

Daniel Ortiz allegedly helped his mother deliver the flower pots in early May to a relative's home in the 6700 block of Foster Bridge Road in Bell Gardens. One of the pots contained Wiggins' head, and the other contained his arms, Gallegos said.

Gallegos said she did not know Chanel Alicia Ortiz's alleged involvement.

At Wiggins' home on Thursday, his son, daughter-in-law and neighbors were loading a moving truck with the man's possessions.

His daughter-in-law, Michelle Wiggins, said Wiggins' landlord asked his family members to clear out the home as soon as possible.

Michelle Wiggins said that Samuel Wiggins was retired, and a former serviceman who fought in the Vietnam War.

"He was a good man that didn't deserve this," she said. "He was a great father and father-in-law. He's going to be greatly missed."

Wiggins lived in the Meadow Falls Drive home for at least 10 years, neighbors said.

A woman who lives in the neighborhood said she believes Samuel Wiggins and Carmen Montelongo met through the Internet. She said she was unsure how long they dated, though she said she believed it was a short time.

The neighbor, who asked to remain unnamed, said Montelongo and her daughter also lived in Wiggins' home for a brief period.

Montelongo appeared in West Valley Superior Court on Thursday for a brief hearing in which Deputy Public Defender Rebecca Taft was confirmed as her attorney.

Montelongo's only statement during the hearing was "correct," which she said in response to a question from Judge Michael Libutti about whether she wished to be represented by Taft.

Montelongo is in custody in lieu of $1 million bail. She was handcuffed during the hearing and her legs were shackled.

She wore orange scrubs, which indicate she's being housed in the general population area of West Valley Detention Center in Rancho Cucamonga.

Taft said during the hearing that she plans to visit Montelongo today. Taft withdrew Montelongo's request at her arraignment Tuesday for reduced bail.

Montelongo is set to return to court Monday. Her children may also be arraigned today or Monday if they are charged in the case, Gallegos said.

Authorities have given conflicting statements as to Montelongo's true name and age.

Montelongo has been identified in some police news releases as Montenegro, but a police spokesman said Wednesday that Montelongo is her true name and Montenegro is an alias.

In mail scattered in the suspect's frontyard in the 6200 block of Indian Camp Road in Riverside, she is identified as Carmen Montelongo. She is also a plaintiff in a lawsuit in San Bernardino County under that name.

Parra identified her as Montelongo in his declaration of probable cause.

Police found a torso and legs at the address, which was the home of some of Montenegro's relatives, and later discovered a head and arms in two large flower pots that Montenegro and her son delivered on Mother's Day to another relative's address in Bell Gardens, near Los Angeles.

The body parts all have been identified as Wiggins' and an autopsy was under way Thursday to determine how Wiggins was killed, authorities said.

Montenegro's two adult children were arrested late Wednesday on suspicion of helping their mother dispose of the remains.

Daniel Ortiz, 25, and Chanel Alicia Ortiz, 26, both of Riverside, were stopped in Rancho Cucamonga and could be charged as early as Friday, Hidalgo said.

It was not immediately clear if they had retained attorneys.

"It's hard to comprehend that someone could be so callous and pushing body parts down the street in a trash can like it was nothing," Hidalgo said. "She was desperate and she was looking for people to help her dispose of the body."

Authorities believe Montenegro killed Wiggins at his home in Diamond Bar, in Los Angeles County, and then transported the remains to her relative's home in Ontario, where she buried the body parts. She dug several deep holes and told relatives she was re-doing the garden, Hidalgo said.

Investigators have also discovered carpet at a home in Riverside where Montenegro was renting storage space, Hidalgo said. The carpet was in a large cardboard box that was used to deliver a sofa and is believed to have come from the victim's house, he said.

At some point, Montenegro uncovered the body and put the head and arms in flower pots that were delivered to the Bell Gardens address, he said.

A family member of Montenegro's, Matthew Bell, told The Sun that he saw Montenegro in a hole in the backyard of his grandmother's house on Sunday. He said he also saw her throw body parts in the trash can and that she offered him $5,000 to help dispose of the remains.

Bell said he instead went to call police and that Montenegro followed him with the trash can, still pleading for help.

DA: Child molester, 64, found slain in prison

12-12-2011 Massachusetts:

An aging child molester was murdered in prison just a few months before he was set to be released after spending nearly 10 years behind bars, authorities said.

Department of Correction spokeswoman Diane Wiffin said the inmate, Richard Silva 64, was discovered about 3 p.m. yesterday by a guard doing rounds during a shift change at MCI-Norfolk.

Norfolk District Attorney Michael Morrisey’s office said state police assigned to the office are investigating.

“Due to evidence at the scene, the death is being investigated as a probable homicide,” a spokesman for the office said in a statement last night.

Wiffin said Silva, whose last known address was in Lowell, was sentenced to nine to 10 years in prison. He was convicted of indecent assault and battery of a child under 14 in January 2003. He was due to be released in March 2012.

She said the assault happened in May 1989.

Morrissey’s office said no one has yet been charged or arrested for the death.

According to the Sex Offender Registry Board’s online database, an incarcerated Richard Silva of the same age and with the same 1991 conviction date had two prior convictions for indecent assault and battery on a child under 14, in 1971 and in 1973. ..Source.. by O’Ryan Johnson

Convicted killer accused of prison murder

A career criminal serving life for the murder of one woman, and awaiting trial in another killing, was charged today with last month’s slaying of fellow MCI-Norfolk inmate Richard Silva, a convicted child molester.

Christopher Fletcher, 50, formerly of Leominster, was indicted by a Norfolk grand jury for beating Silva, 64, to death on Dec. 12, as Silva was nearing the end of his incarceration on sexual abuse charges, Norfolk District Attorney Michael W. Morrissey said.

Fletcher’s attorney declined comment. Morrissey’s spokesman, David Traub, declined to comment on what evidence prosecutors hold, including whether it includes prison security video.

An arraignment date has not been set.

Fletcher, who the Department of Correction has moved to maximum security at the Souza-Baranowski Correctional Center, pleaded not guilty to charges of murder, rape and kidnapping earlier this month in Worcester Superior Court for the December 1986 slaying in Sterling of Peggy Sue Calvillo, 24, a factory worker and mother of two police believed Fletcher first ran down with a car.

Fletcher is already serving life without parole for the 1995 murder of Elizabeth Salsbury of Lunenberg. When he was arrested for Salsbury’s murder, he told police he had killed before and confessed to Calvillo’s murder, Worcester District Attorney Joseph Early Jr. said.

Salsbury’s body was found behind a car dealership in Shirley. Police said she had been stabbed repeatedly in the throat.

“I commend the correction officers, administration and investigators at the Department of Correction for their constructive partnership and hard work in this investigation, and thank the Massachusetts State Police Crime Scene Services Section and the homicide detectives attached to the Norfolk District Attorney’s Office for their continued professionalism and hard work,” Morrissey said today.

Richard Silva , 64, was serving prison time for a 2003 Suffolk Superior Court sexual abuse conviction, according to Department of Correction spokeswoman Diane Wiffin. The offenses occurred in May 1989, but they were only the latest in a string of sexual abuse convictions dating back to the 1970s, according to the state’s Sex Offender Registry Board.

Silva was scheduled to be released in March after serving a nine- to 10-year stretch for a 2003 sexual abuse conviction. He’d previously been convicted of indecent assault and battery on a child under 14 in 1971, 1973 and 1974. Homicide Unit investigating prisoner’s death

North Branch Correctional Institution inmate found unresponsive inside celll

CRESAPTOWN — The suspicious death of an inmate at the North Branch Correctional Institution on U.S. Route 220 is being investigated by the Internal Investigative Unit of the Maryland Department of Public Safety and Correctional Services and the Maryland State Police Homicide Unit.

Correctional officers found the 57-year-old inmate unresponsive in his cell in Housing Unit 3 of the maximum-security prison shortly after 6 p.m. Thursday and immediately started CPR until paramedics arrived. Officers were alerted after “an inmate approached a correctional officer and said something was wrong with his cell mate,” police said.

The unresponsive inmate was taken to the Western Maryland Regional Medical Center where he was pronounced dead.

The identity of the inmate is being withheld pending notification of his family. He was serving 40 years on a rape charge.

Cresaptown Volunteer Fire Department ambulance responded to the call at 6:20 p.m., according to the Allegany County 911 center.

The Maryland State Medical Examiner will determine the cause and manner of death.

Inmate's death caused by strangulation, ruled a homicide

CUMBERLAND, Md. — Maryland State Police say an inmate who was found unresponsive in a Cumberland prison was strangled and his death has been ruled a homicide.

Fifty-seven-year-old Lewis J. Thompson Jr. was found in his cell at the North Branch Correctional Institution on Dec. 8 and pronounced dead at a local hospital. He was serving a 40-year sentence on a rape charge.

Man killed in mobile-home park identified

12-2-2011 California:

Deputies identify the victim as Bobby Ray Rainwater – a name that appears on a state website of registered sex offenders.

SAN JUAN CAPISTRANO – Deputies responding to an early-morning disturbance call at a mobile-home park here found a man dead in the street outside his home.

Investigators were releasing few details Thursday afternoon, but they were treating the man's death as a homicide and said it was not a random crime.

"There's not a danger to the community," Orange County Sheriff's Lt. Steve Doan said. "We're not looking for somebody running around the neighborhood."

The Sheriff's Department identified the victim as 54-year-old Bobby Ray Rainwater. A man by that name and age is registered as a sex offender on California's Megan's Law website, with an address in San Juan Capistrano.

He was convicted of assault with intent to commit a specified sex offense, according to the website. It does not provide other details, and Bobby Rainwater does not appear in criminal court records in Orange or Los Angeles counties.

Rainwater worked as a handyman and lived with his elderly parents at the San Juan Mobile Estates, park manager Ted Roberts said. A woman who answered the phone at the family's home immediately hung up.

Deputies were called to a disturbance at the mobile-home park in the 32000 block of Alipaz Street around 5:30 a.m. Thursday. Doan did not know who was involved in the disturbance, or who called to report it.

Arriving deputies found Rainwater in the street just outside his home. He had obvious injuries, but the Sheriff's Department was not releasing details about the manner of his death because of its ongoing investigation.

Deputies were interviewing Rainwater's family and neighbors and were "zeroing in on some things," Doan said. They had not made any arrests or named any suspects, but Doan said: "This person was not the victim of a random crime."

UPDATE: Man Killed at Mobile Home Park ID'd

The body of a 54-year-old man was found outside his mobile home residence early Thursday in what authorities consider a homicide.

Orange County Sheriff's deputies later identified the man as Bobby Ray Rainwater, who lived in the San Juan Mobile Estates park with his elderly parents, said Lt. Steve Doan.

A Bobby Ray Rainwater is also listed as a sex offender on the state's Megan's Law registry. Although the Sheriff's Department wouldn't confirm any connection, both have the same birthdate and town of residence, San Juan Capistrano.

The registry says Rainwater was convicted of assault with intent to commit a specified sex offense, but provided no details. He had several tattoos, including a dragon, devil, and skull and crossbones.

The Sheriff's Department received a 911 call around 5:30 a.m. about a disturbance at the mobile home park at 32302 Alipaz St. When they arrived on the scene, they found Rainwater's body outside a mobile home on Paseo Perdido.

"The victim was already deceased when deputies arrived, but we don't know for how long," Doan said.
